July 2010:Griffith Nixon Davison Fields Team for Softball Tournament

Griffith Nixon Davison, P.C.’s attorneys and other employees will be participating in an all-day softball tournament on Saturday, July 17, sponsored by TEXO and the Young Constructors Council. Stewart Shurtleff, Attorney at GND and Manager says of GND’s prospects for winning, “After two practices, I think I can say with some level of confidence: We are simply not very good. We have no pitching and very little hitting ability. Not to mention, most of us will be unable to play more than two games in the 105 degree Texas heat.”



July 2010:Tony Jach Delivers Speech on Contingent Payment Clause Issues

Tony JachTony Jach, a Partner at Griffith Nixon Davison, P.C., delivered a speech titled, “An Update on Contingent Payment Clause Issues” to the Dallas Bar Association Construction Law Section on Thursday, July 1, 2010 at The Belo Mansion in Dallas. The speech covered the recent recodification of the statute enforcing contingent payment provisions in construction contracts, provided a background of contingent payment clause issues and discussed the application of the statute and the various exceptions and exemptions.



June 2010:GND Attorneys Attend State Bar of Texas Annual Meeting

Numerous GND attorneys attended and represented the firm at the State Bar of Texas Annual Meeting, held June 10-11 at the Fort Worth Convention Center and Omni Hotel. The State Bar of Texas is an administrative agency of the Supreme Court of Texas that provides educational programs for the legal profession and the public, administers the minimum continuing legal education program for attorneys, and manages the attorney discipline program. The purpose of the Annual Meeting is to provide opportunities for Attorneys across the State of Texas to come together to celebrate the profession, attend numerous continuing education courses in various areas of practice, and to network with other lawyers. The firm prides itself on being involved in and contributing to the State Bar of Texas!



June 2010:GND Introduces Associate Attorney

GND is pleased to announce the addition of a new associate, Mr. Dylan O. Drummond.

Dylan Drummond will be practicing as an Associate in GND’s Litigation Section. A Texas native, Mr. Drummond graduated from Texas Tech University with a B.S. in 1999. A summa cum laude graduate who was first in his graduating class, Mr. Drummond was a member of the Mortar Board, Omicron Delta Kappa and Phi Kappa Phi during his undergraduate education. Thereafter, in 2003, Mr. Drummond received both his J.D. and M.B.A. degrees from the Texas Tech University School of Law and the Texas Tech College of Business Administration, respectively. While in law school, Mr. Drummond was Editor in Chief of the Texas Tech Administrative Law Journal and also served on the Editorial Board of the Texas Bank Lawyer.

During the Texas Supreme Court’s 2003-04 term, Mr. Drummond served as a Briefing Attorney for Senior Associate Justice Nathan L. Hecht, and subsequently practiced as an Associate in the Appellate and Environmental Practice Groups at two of the state’s largest law firms. Mr. Drummond has authored numerous articles in various publications such as the Texas Tech Law Review, Texas Lawyer, Appellate Advocate, as well as the Houston Lawyer, among others, and is a frequent speaker/presenter at various seminars and conferences related to appellate practice, administrative law, and other various areas of law.

Mr. Drummond is licensed to practice law in all Texas state Courts, the United Stated Supreme Court, the Fifth Circuit Court of Appeals, and the United Stated District Courts for the Southern and Northern Districts of Texas.

In addition to numerous other honors and awards, Mr. Drummond was recently renamed as a Texas Rising Star in Appellate Practice by Texas Monthly & Thomson Reuters, and currently serves as the Co-Editor of the Texas Bar Appellate Section’s quarterly journal, the Appellate Advocate.

June 2010:GND Introduces New Associate

GND is pleased to announce the addition of a new attorney to the firm, Mr. John E. Roper, who will be working as an Associate in GND’s Litigation Section.

Mr. Roper attended The University of Texas, where he graduated with a Bachelor of Science degree in Microbiology in 1998. In 2002, Mr. Roper graduated second in his class from South Texas College of Law where he was a member of Order of the Lytae and Note & Comment Editor for the South Texas Law Review.

In his 7+ year legal career practicing both in state and federal courts, Mr. Roper has gained extensive trial experience. Mr. Roper practiced law in the trial section of one of the state’s largest law firms, representing business entities and individuals in matters involving construction and lien law, commercial law, personal injury and creditors’ rights and remedies.

Mr. Roper is licensed to practice law in Texas state court as well as the U.S. District Courts for the Northern District of Texas and Eastern District of Texas. Mr. Roper is a member of the American Bar Association, the Defense Research Institute, the Texas Association of Defense Counsel, Scribes, and Phi Delta Phi. Additionally, Mr. Roper is involved in the community as a member of the Business Council for the Arts 2010 Leadership Arts Class and enjoys doing pro bono work through Legal Aid of Northwest Texas.

April 2010:GND Attorneys Attend ABA Forum on the Construction Industry

ABA LogoGND Partners Scott Griffith and Kimber Davison and Director Jason Cagle attended and represented the firm at the annual American Bar Association’s Forum on the Construction Industry Conference, held April 22-24, 2010 in Austin, Texas. The ABA Forum on the Construction Industry is the largest organization of construction lawyers in the United States and abroad. Its 6,000 members represent all segments of the Construction industry including owners, design professionals, general contractors, construction managers, subcontractors, suppliers, insurers and sureties. The Forum’s mission is to serve the construction industry through education and leadership by hosting numerous publications, seminars, continuing education courses and it’s annual conference. The 2010 annual conference program, titled “The Age of Turbulence: Managing Money Issues in Construction”, focused on the economic element from concept to closeout, from initial funding to collections, from owner/developer to designer, and from contractor to lawyer.

March 2010:Attorneys Attend State Construction Law Conference

Eight attorneys attended and represented Griffith Nixon Davison, P.C. at the 23rd Annual Construction Law Conference which was held February 25-26 at the Westin La Cantera Resort in San Antonio. The Annual Conference held each spring is sponsored by the Construction Law Section of the State Bar of Texas in cooperation with The Texas Institute of Continuing Legal Education and features the hottest topics presented by leading construction law professionals.

February 2010:GND Associate Sarah MarDock to Deliver Speech on Social Networking

Sarah MarDockSarah MarDock, a GND Litigation Associate, will be delivering a speech titled “The Legal Implications of Social Networking” to the TEXO Women’s Forum in Dallas on February 17, 2010. As the title of her speech suggests, Ms. Mardock’s speech will be focused on the wide world of social networking. She will explain the workings of Facebook, Twitter, LinkedIn and blogging, with an emphasis on how these tools can be used both as personal and business networking tools. In addition, Ms. Mardock will address some of the legal implications and ramifications of social networking for employers and employees. The speech will take place at 12:00pm on February 17, 2010 at TEXO’s Dallas Conference Center at 11111 N. Stemmons Frwy, Dallas, Texas, 75229.

Ms. MarDock is a graduate of Southern Methodist University’s Dedman School of Law, where she participated in both the ABA and National Moot Court Competition and was a member of the SMU Student Bar Association. Prior to attending law school, Sarah earned her undergraduate degree in Finance from the University of Texas in Austin.

January 2010: Article Appears in Dallas Bar Association’s Headnotes

The January edition of the Dallas Bar Association’s HEADNOTES features an article authored by Mike Nixon. The article is titled, “Five Things Every Non-Construction Lawyer Should Know About Construction Law.” In the article, Mr. Nixon discusses various construction law issues including Texas lien law, the basics of the AIA documents and the law regarding removables. January 2010: Griffith Nixon Davison, P.C. Serves with Salvation Army

Griffith Nixon Davison, P.C. took part in a service opportunity with Salvation Army-Dallas over the holidays. The firm spent two evenings serving nearly 1,000 meals to the Dallas area homeless at the Salvation Army’s Carr P. Collins Social Service Center. It was an honor to partner with Salvation Army and have a small hand in the great work they do in and around the DFW Metroplex. Click here for photos.



December 2009: GND Names New Partner

Curtis HubbardGND is happy to announce the addition of a new partner, Curtis Hubbard, who has served as a Director in the Firm’s Litigation Section since 2007. Mr. Hubbard attended Arkansas Tech University where he graduated Magna Cum Laude in 1998. In 2000, Mr. Hubbard graduated from the Baylor University School of Law where he was a member of Phi Delta Phi and an Executive Editor of the Baylor Law Review. Mr. Hubbard joined the firm immediately upon graduating from law school. In his 10 years with the firm, Mr. Hubbard has gained extensive trial and litigation experience, handling complex construction matters, as well as general commercial and business litigation matters. Mr. Hubbard is a member of the State Bar of Texas’ and Dallas Bar Association’s Construction Law Section and Business Litigation Section. In addition to being admitted to the State Bar of Texas, Mr. Hubbard is also admitted to the U.S. District Court for the Northern, Southern and Eastern District of Texas and is licensed to practice law in the State of Arkansas. Mr. Hubbard is married to Jennifer Hubbard, an Associate with Griffith Nixon Davison, P.C.. Curtis and Jennifer and their children reside in Frisco, where Curtis serves on the Frisco Chamber of Commerce.


December 2009: GND Appoints New Director

Jason CagleGND is pleased to announce that Jason Cagle, an Associate in the Firm’s Litigation Section since 2008, has been appointed as a Director of the firm. Mr. Cagle graduated magna cum laude from Loyola Marymount University in 1998 with a degree in Political Science and a Minor in Computer Science. He then attended and graduated from Vanderbilt University School of Law where he served as Articles Editor of the Law Review and was a member of the Order of the Coif and Moot Court Board. Mr. Cagle is an active member of the American Bar Association, the State Bar of Texas, the Dallas Bar Association, the Texas Young Lawyers’ Association, the Dallas Association of Young Lawyers and the Defense Research Institute. In addition to being licensed to practice law in the State of Texas, Mr. Cagle is also licensed in the State of New York and is admitted to practice law in all U.S. District Courts in Texas, the U.S. District Courts for the Eastern and Southern Districts of New York and the U.S. Court of Appeals for the Fifth Circuit. Mr. Cagle is an active member of the Dallas Volunteer Attorneys Program and serves as a Judge for the Texas High School Mock Trial Competition. Jason and his wife and son reside in Dallas.


December 2009: Scott Griffith Appointed to TEXO Association Board of Directors

Scott GriffithScott Griffith, Founding Partner, has been elected to serve on the TEXO Association Board of Directors. TEXO is the Construction Association representing commercial contractors in North and East Texas. With over 1,900 members, TEXO is the largest commercial contractors association in Texas. TEXO provides its members with innovative programs, quality services and strategic alliances while protecting a merit shop working environment. The Association maintains a strategic focus on specific areas such as governmental representation, safety, health and environmental issues, professional training and education and community and networking events. Mr. Griffith began his three-year term on the TEXO Association Board of Directors in the fall of 2009.


December 2009: Kimber Davison Elected to State Bar of Texas Construction Law Section Council

Kimber DavisonKimber Davison, Managing Partner, was recently nominated and elected to serve on the State Bar of Texas Construction Law Section Council. The Construction Law Section is made up of over 1,000 legal professionals serving in both the public and private sectors across the state of Texas. In addition to publishing the Texas Construction Law Journal, the Section holds an Annual Conference each spring featuring the hottest topics and leading construction law professionals, as well as the Basic Course in Texas Construction Law which is held each fall for those attorneys new to the field. Ms. Davison has begun a three year term as a Member on the Construction Law Section Council and will serve through 2012. December 2009: GND Transactional Section Completes "Warp Speed" Closing

The GND transactional section completed representation of the Seller in the sale of an office building where closing was accomplished in less than six weeks.
