December 2011:GND Associates Published in Texas Bar Journal

GND Associates Dylan Drummond and Stephen Bolline authored and contributed submissions to the Texas Bar Journal’s annual “Party Talk” feature, published in the December edition. The Texas Bar Journal’s “Party Talk” is designed to give expert lawyers the opportunity to provide answers to common legal questions. Mr. Drummond’s submission addressed post-judgment collection and supersedeas bonds. Mr. Bolline’s article dealt with issues relating to the discovery of construction defects.




December 2011:GND Attorneys Play Significant Role in Construction Basics Course

GND Partners Kimber Davison and Curtis Hubbard and GND Associate Jeff Leach took part in leading the annual Basic Course in Texas Construction Law, sponsored by The Construction Law Section of the State Bar of Texas. The Basics Course is intended for Texas lawyers and construction industry members and professionals who are interested in acquiring a basic knowledge of Texas construction law. Ms. Davison, a member of the Council of the Construction Law Section, was responsible for planning the substance of the Course program, including the selection of speakers. Mr. Hubbard was the Presiding Officer of the Course. Jeff Leach delivered a speech titled “2011 Construction Legislative Update”, which addressed the latest construction-related developments arising out of the 2011 Legislative Session.



October 2011:Scott Griffith Moderates Panel Discussion at Construction Industry Fall Meeting

Scott GriffithScott Griffith coordinated and moderated a panel discussion at the ABA Forum on the Construction Industry 2011 Fall Meeting, held October 13-14 in Atlanta, Georgia. The panel discussion titled “Multi-Party Arbitrations: A Discussion of Legal Issues and Practical Tips” was enhanced by Mr. Griffith’s extensive arbitration experience. The discussion focused specifically on various techniques and strategies involved in arbitrating construction disputes when multiple parties are involved and the legal framework governing said arbitrations. The ABA Forum on the Construction Industry is the largest organization of construction lawyers in the United States and abroad.




October 2011:Kimber Davison to Deliver Presentation on Recent Indemnity Legislation in Texas

Kimber DavisonGND Partner Kimber Davison will deliver a speech later this month to North Texas general contractors, subcontractors, owners, developers, insurers and construction attorneys titled “Dotting Your I’s … Insurance and Indemnity in 2012”. Ms. Davison’s presentation is being hosted by the TEXO Governmental Affairs Committee and will be delivered on October 27, 2011 at 3:00pm at the TEXO Conference Center at 11111 N. Stemmons Frwy., Dallas, Texas, 75229. The speech will focus on the action taken during the 2011 Texas Legislative Session that brought significant changes to the way the construction industry conducts business in Texas, including the two new laws that create new standards for indemnification and certificates of insurance. The presentation will provide the context of the current laws, as well as a thorough explanation of the upcoming changes. August 2011:Kimber Davison Delivers Speech on "Consensus Docs

Kimber DavisonOn August 4, 2011, GND Partner Kimber Davison delivered a speech to the Dallas Bar Association Construction Law Section titled, “Consensus Docs: What They Are, How They Have Been Updated and Why You Should Use Them.” The presentation discussed a wide range of topics relating to Consensus Docs, including the origins of Consensus Docs, the various forms included in the family of standard form construction documents, and the 2011 updates to the forms.




August 2011:GND Associate Dylan Drummond Appointed to State Bar of Texas Committee

Dylan DrummondGND Associate Dylan Drummond was recently appointed by the President of the State Bar of Texas to the Standing Committee on the questions submitted to juries – Business, Consumer, Insurance and Employment. The Committee prepares and periodically revises the pattern jury charges used in Texas trial courts that touch upon business, consumer, insurance and employment matters. Mr. Drummond’s term on the committee will run from 2011 through 2014.




August 2011:GND Associate Named to Editorial Board of Newsletter

Dylan DrummondGND Associate Dylan Drummond was recently asked to serve on the editorial board of a newly-formed quarterly newsletter to be published by the Texas Supreme Court Historical Society and distributed to its membership. The Texas Supreme Court Historical Society is a nonpartisan, nonprofit organization dedicated to the collection and preservation of papers, photographs, and significant artifacts relating to the Supreme Court of Texas, the appellate courts, and Texas judicial history.




June 2011:GND Associate Earns Certified Financial Planner Certification

May 2011:GND Associate Dylan Drummond Quoted in Lubbock Avalanche Journal Article

Dylan DrummondGND associate Dylan Drummond was recently quoted in the Lubbock Avalanche-Journal’s April 6, 2011 article on proposed legislation currently moving through the 82nd Texas Legislative Session. Mr. Drummond also testified in March at a public hearing held in the Texas Senate to debate the merits of the proposed legislation from a legal standpoint. Mr. Drummond has been invited to speak on various topics of law by the University of Texas as well as the Texas Wildlife Association and Texas and Southwestern Cattle Raisers Association, and his publications have been cited eleven times in briefing to the Texas Supreme Court.

April 2011:GND Attorneys Author Section for American Bar Association Publication

GND Managing Partner Kimber Davison and GND Associate Jeff C. Leach were contributing authors for the 2010-2011 Construction Case Law and Legislation Update recently published by the American Bar Association Forum on the Construction Industry. March 2011:Harold Buell Authors Article for Dallas Bar Association Publication

The April 2011 edition of the Dallas Bar Association’s Headnotes features an article authored by GND Real Estate and Corporate Law Associate, Harold Buell. The article is titled “Authority Documentation in Real Estate Transactions”. In the article, Mr. Buell discusses various issues relating to the multitude of authority documents often required by buyers, sellers and lenders in real estate transactions and the covenants, representations, warranties and other pitfalls contained therein. March 2011:Scott Griffith Speaks at 2011 Annual State Bar Construction Law Conference

Scott GriffithScott Griffith delivered a speech titled “The Use of Experts in Construction Litigation: The Title May Make You Sleepy, But the Subject Matter Will Keep You Up At Night” at the 24th Annual State Bar of Texas Construction Law Conference on March 4th, 2011. The content of the speech was based on a recent paper co-authored by Scott Griffith and GND Associates Dylan Drummond and Sarah Mardock which provides an in-depth analysis of state and federal law concerning the use of experts in construction litigation including when expert testimony is required and/or allowed, the various types of construction experts, designations, reports and disqualification. March 2011:Dylan Drummond Speaks at Texas State Historical Association Annual Meeting

GND Attorney Dylan Drummond spoke at the 115th Texas State Historical Association Annual Meeting held March 3-5 in El Paso, Texas. Mr. Drummond’s speech was part of a joint session between the Texas State Historical Association and the Texas Supreme Court Historical Society entitled, “Subterranean Wars: The Legal Battle over Ground Water in Texas, 1900-2000.” Mr. Drummond’s presentation was entitled “Texas Groundwater Rights and Immunities: From East to Sipriano and Beyond” and focused on the historical background of the rule of capture and the Texas Supreme Court’s 1999 decision in Sipriano v. March 2011:GND Attorneys Attend 2011 Texas Construction Law Conference

Several GND attorneys attended and represented the firm at the 24th Annual Construction Law Conference which was held March 3-4 at the Westin La Cantera Resort in San Antonio. The Annual Conference held each spring is sponsored by the Construction Law Section of the State Bar of Texas in cooperation with The Texas Institute of Continuing Legal Education and features presentations on a variety of construction law topics presented by leading construction law professionals.


January 2011:Kimber Davison Earns Certification from Texas Board of Legal Specialization

Kimber DavisonGND Partner Kimber Davison has earned the designation of being Board Certified in Commercial Real Estate by the Texas Board of Legal Specialization. Board Certification is a designation program certifying Texas attorneys in various areas of law and is the only specialization program for lawyers in Texas. Less than ten percent of all Texas attorneys are Board Certified in any area of law. To be Board Certified, an Attorney must be licensed for at least five years, devote a required percentage of practice to a specialty area for at least three years, attend continuing education seminars, pass an evaluation given by fellow lawyers and judges and also pass a six hour written examination. January 2011:GND Attorneys Attend ABA Forum on the Construction Industry Mid-Winter Meeting

GND Partners Scott Griffith and Kimber Davison attended and represented the firm at the 2011 Midwinter Joint Meeting sponsored by the ABA Forum on the Construction Industry and the TIPS Fidelity and Surely Law Committee held January 20 in New York City. The 2011 Meeting focused on Alternative Dispute Resolution including sessions on advanced negotiation strategies, arbitration vs. litigation, as well as ethical considerations for construction-related dispute resolution. The ABA Forum on the Construction Industry is the largest organization of construction lawyers in the United States and abroad. Its 6,000 members represent all segments of the Construction industry including owners, design professionals, general contractors, construction managers, subcontractors, suppliers, insurers and sureties. The Forum’s mission is to serve the construction industry through education and leadership by hosting numerous publications, seminars, continuing education courses and it’s annual conference.


January 2011:GND Attorney Attends State Bar of Texas Litigation Update Institute

Jeff LeachGND Attorney Jeff Leach represented the firm at the 27th Annual Litigation Update Institute held January 20-21, 2011 in San Antonio, Texas. The annual Litigation Update, co-sponsored by TexasBarCLE and the Litigation Section of the State Bar of Texas, focuses on a broad range of litigation topics including updates from the Supreme Court of Texas, business and commercial law, environmental law, labor and employment law and energy law updates, as well as numerous sessions on trial and procedural tactics and strategy. The Litigation Section of the State Bar of Texas, of which several GND Attorneys are members, is the largest section of the State Bar of Texas, with over 7,400 members whose practices in some way touch upon all types of trial work.


December 2010:Firm Partners with Airborne Angel Cadets of Texas and Welcomes Troops Home

The attorneys and support staff at Griffith Nixon Davison, P.C. again took part in a holiday service opportunity, this year partnering with Airborne Angel Cadets of Texas in the preparation of care packages to send to American soldiers in Iraq, Afghanistan and other overseas posts. Airborne Angel Cadets of Texas sends care packages year round to American troops spread throughout the world, concentrating their efforts on troops on the frontlines and in remote areas. November 2010:Article Co-Authored by Dylan Drummond Appears in the Appellate Advocate

The Fall 2010 edition of The Appellate Advocate, the State Bar of Texas Appellate Section Report, contains an article co-authored by Griffith Nixon Davison, P.C. Attorney Dylan Drummond. The Article entitled, “In Defense of Confidential Votes on Petitions for Review at the Texas Supreme Court” presents a strong case for continuing the long-standing tradition of the Supreme Court of Texas’ practice in keeping its docket votes confidential which, as of late, has come under intense scrutiny. October 2010:GND Attorney Delivers Speech on Liens for Removables

Stewart ShurtleffOn Tuesday, October 12, 2010, Stewart Shurtleff, an Attorney at Griffith Nixon Davison, P.C., delivered a speech titled “The Basics of Removables Claims” to “Ladies Luncheon”. “Ladies Luncheon”, founded by Kimber Davison, the firm’s Managing Partner, in 2002, is a group of professional women from the DFW Metroplex who gather monthly to discuss various topics pertinent to the construction, real estate and general business communities. Mr. Shurtleff’s speech covered the basics of claims for removables, including a discussion of the procedures for perfecting a lien for removables, as well as specific nuances regarding removables and how priority liens can be effectively utilized in the commercial construction context.

GND Attorneys Scott Griffith, Mike Nixon and Chris Carter attended and represented the firm at the DRI (Defense Research Institute) Construction Law Seminar, held September 30-October 1 in Las Vegas. DRI is the international organization of attorneys defending the interests of businesses and individuals in civil litigation. GND Attorneys Mike Nixon, Jennifer Hubbard and Jeff Leach attended and represented the firm at the UTCLE Construction Law Conference, held September 23-24, 2010 in Dallas. August 2010:GND Attorney Delivers Speech on Lawsuit Reform in Texas

Jeff LeachGND Associate Attorney, Jeff Leach, delivered a speech on July 27, 2010 to the HEB Rotary Club titled, “Lawsuit Reform in Texas.” In his speech, Mr. Leach discussed the history of lawsuit reform in Texas over the past 15-20 years and the economic impact of those reforms. Mr. Leach also covered several specific issues in connection with the future direction of lawsuit reform and the impact on local businesses.




July 2010:Griffith Nixon Davison Fields Team for Softball Tournament

Griffith Nixon Davison, P.C.’s attorneys and other employees will be participating in an all-day softball tournament on Saturday, July 17, sponsored by TEXO and the Young Constructors Council. Stewart Shurtleff, Attorney at GND and Manager says of GND’s prospects for winning, “After two practices, I think I can say with some level of confidence: We are simply not very good. We have no pitching and very little hitting ability. Not to mention, most of us will be unable to play more than two games in the 105 degree Texas heat.”



July 2010:Tony Jach Delivers Speech on Contingent Payment Clause Issues

Tony JachTony Jach, a Partner at Griffith Nixon Davison, P.C., delivered a speech titled, “An Update on Contingent Payment Clause Issues” to the Dallas Bar Association Construction Law Section on Thursday, July 1, 2010 at The Belo Mansion in Dallas. The speech covered the recent recodification of the statute enforcing contingent payment provisions in construction contracts, provided a background of contingent payment clause issues and discussed the application of the statute and the various exceptions and exemptions.



June 2010:GND Attorneys Attend State Bar of Texas Annual Meeting

Numerous GND attorneys attended and represented the firm at the State Bar of Texas Annual Meeting, held June 10-11 at the Fort Worth Convention Center and Omni Hotel. The State Bar of Texas is an administrative agency of the Supreme Court of Texas that provides educational programs for the legal profession and the public, administers the minimum continuing legal education program for attorneys, and manages the attorney discipline program. The purpose of the Annual Meeting is to provide opportunities for Attorneys across the State of Texas to come together to celebrate the profession, attend numerous continuing education courses in various areas of practice, and to network with other lawyers. The firm prides itself on being involved in and contributing to the State Bar of Texas!



June 2010:GND Introduces Associate Attorney

GND is pleased to announce the addition of a new associate, Mr. Dylan O. Drummond.

Dylan Drummond will be practicing as an Associate in GND’s Litigation Section. A Texas native, Mr. Drummond graduated from Texas Tech University with a B.S. in 1999. A summa cum laude graduate who was first in his graduating class, Mr. Drummond was a member of the Mortar Board, Omicron Delta Kappa and Phi Kappa Phi during his undergraduate education. Thereafter, in 2003, Mr. Drummond received both his J.D. and M.B.A. degrees from the Texas Tech University School of Law and the Texas Tech College of Business Administration, respectively. While in law school, Mr. Drummond was Editor in Chief of the Texas Tech Administrative Law Journal and also served on the Editorial Board of the Texas Bank Lawyer.

During the Texas Supreme Court’s 2003-04 term, Mr. Drummond served as a Briefing Attorney for Senior Associate Justice Nathan L. Hecht, and subsequently practiced as an Associate in the Appellate and Environmental Practice Groups at two of the state’s largest law firms. Mr. Drummond has authored numerous articles in various publications such as the Texas Tech Law Review, Texas Lawyer, Appellate Advocate, as well as the Houston Lawyer, among others, and is a frequent speaker/presenter at various seminars and conferences related to appellate practice, administrative law, and other various areas of law.

Mr. Drummond is licensed to practice law in all Texas state Courts, the United Stated Supreme Court, the Fifth Circuit Court of Appeals, and the United Stated District Courts for the Southern and Northern Districts of Texas.

In addition to numerous other honors and awards, Mr. Drummond was recently renamed as a Texas Rising Star in Appellate Practice by Texas Monthly & Thomson Reuters, and currently serves as the Co-Editor of the Texas Bar Appellate Section’s quarterly journal, the Appellate Advocate.

March 2010:Attorneys Attend State Construction Law Conference

Eight attorneys attended and represented Griffith Nixon Davison, P.C. at the 23rd Annual Construction Law Conference which was held February 25-26 at the Westin La Cantera Resort in San Antonio. The Annual Conference held each spring is sponsored by the Construction Law Section of the State Bar of Texas in cooperation with The Texas Institute of Continuing Legal Education and features the hottest topics presented by leading construction law professionals.

January 2010: Article Appears in Dallas Bar Association’s Headnotes

The January edition of the Dallas Bar Association’s HEADNOTES features an article authored by Mike Nixon. The article is titled, “Five Things Every Non-Construction Lawyer Should Know About Construction Law.” In the article, Mr. Nixon discusses various construction law issues including Texas lien law, the basics of the AIA documents and the law regarding removables. January 2010: Griffith Nixon Davison, P.C. Serves with Salvation Army

Griffith Nixon Davison, P.C. took part in a service opportunity with Salvation Army-Dallas over the holidays. The firm spent two evenings serving nearly 1,000 meals to the Dallas area homeless at the Salvation Army’s Carr P. Collins Social Service Center. It was an honor to partner with Salvation Army and have a small hand in the great work they do in and around the DFW Metroplex. Click here for photos.



December 2009: GND Names New Partner

Curtis HubbardGND is happy to announce the addition of a new partner, Curtis Hubbard, who has served as a Director in the Firm’s Litigation Section since 2007. Mr. Hubbard attended Arkansas Tech University where he graduated Magna Cum Laude in 1998. In 2000, Mr. Hubbard graduated from the Baylor University School of Law where he was a member of Phi Delta Phi and an Executive Editor of the Baylor Law Review. Mr. Hubbard joined the firm immediately upon graduating from law school. In his 10 years with the firm, Mr. Hubbard has gained extensive trial and litigation experience, handling complex construction matters, as well as general commercial and business litigation matters. Mr. Hubbard is a member of the State Bar of Texas’ and Dallas Bar Association’s Construction Law Section and Business Litigation Section. In addition to being admitted to the State Bar of Texas, Mr. Hubbard is also admitted to the U.S. District Court for the Northern, Southern and Eastern District of Texas and is licensed to practice law in the State of Arkansas. Mr. Hubbard is married to Jennifer Hubbard, an Associate with Griffith Nixon Davison, P.C.. Curtis and Jennifer and their children reside in Frisco, where Curtis serves on the Frisco Chamber of Commerce.


December 2009: GND Appoints New Director

Jason CagleGND is pleased to announce that Jason Cagle, an Associate in the Firm’s Litigation Section since 2008, has been appointed as a Director of the firm. Mr. Cagle graduated magna cum laude from Loyola Marymount University in 1998 with a degree in Political Science and a Minor in Computer Science. He then attended and graduated from Vanderbilt University School of Law where he served as Articles Editor of the Law Review and was a member of the Order of the Coif and Moot Court Board. Mr. Cagle is an active member of the American Bar Association, the State Bar of Texas, the Dallas Bar Association, the Texas Young Lawyers’ Association, the Dallas Association of Young Lawyers and the Defense Research Institute. In addition to being licensed to practice law in the State of Texas, Mr. Cagle is also licensed in the State of New York and is admitted to practice law in all U.S. District Courts in Texas, the U.S. District Courts for the Eastern and Southern Districts of New York and the U.S. Court of Appeals for the Fifth Circuit. Mr. Cagle is an active member of the Dallas Volunteer Attorneys Program and serves as a Judge for the Texas High School Mock Trial Competition. Jason and his wife and son reside in Dallas.


December 2009: Scott Griffith Appointed to TEXO Association Board of Directors

Scott GriffithScott Griffith, Founding Partner, has been elected to serve on the TEXO Association Board of Directors. TEXO is the Construction Association representing commercial contractors in North and East Texas. With over 1,900 members, TEXO is the largest commercial contractors association in Texas. TEXO provides its members with innovative programs, quality services and strategic alliances while protecting a merit shop working environment. The Association maintains a strategic focus on specific areas such as governmental representation, safety, health and environmental issues, professional training and education and community and networking events. Mr. Griffith began his three-year term on the TEXO Association Board of Directors in the fall of 2009.


December 2009: Kimber Davison Elected to State Bar of Texas Construction Law Section Council

Kimber DavisonKimber Davison, Managing Partner, was recently nominated and elected to serve on the State Bar of Texas Construction Law Section Council. The Construction Law Section is made up of over 1,000 legal professionals serving in both the public and private sectors across the state of Texas. In addition to publishing the Texas Construction Law Journal, the Section holds an Annual Conference each spring featuring the hottest topics and leading construction law professionals, as well as the Basic Course in Texas Construction Law which is held each fall for those attorneys new to the field. Ms. Davison has begun a three year term as a Member on the Construction Law Section Council and will serve through 2012. December 2009: GND Transactional Section Completes "Warp Speed" Closing

The GND transactional section completed representation of the Seller in the sale of an office building where closing was accomplished in less than six weeks.
